Description

In investigating and defending insurance claims, adjusters will find and develop information, especially statements from the insured, the claimant, witnesses and others. Insurers have a keen interest in taking statements in such a way as to prevent the fruits of their labour from being scooped up by adverse parties (at little or no cost) to the detriment of the insured’s defence. In particular, police have recently been attempting to access statements on the adjuster’s file and evidence from the civil case for use in prosecuting criminal/traffic charges against the insured. This can render the material available to civil claimants and lead to a conviction which may impair or eliminate the ability to defend civil liability.


Join Field Law's Brian Vail and Pablo Retamozo as they present on creating and maintaining privilege and confidentiality over statements and how to minimize the potential adverse impact of evidence from the civil and criminal/traffic proceedings on the other. Topics covered will include:

  1. Driver Statements under Section 71 of the Traffic Safety Act;
  2. Police ability to access and rely upon (a) the insured’s statements to the adjuster;and (b) document production, Questioning transcripts and witness testimony from the civil case
  3. The ability of civil litigants to access the police file in the criminal/traffic case against the insured;
  4. “Apologies” under Alberta’s new apology legislation; and
  5. Privilege regarding statements taken from an adverse litigant, such as the plaintiff.
